Seminar about “Place and Role of Associations of Individual Proprietors of

Housing in Reforms of Housing and Public Utilities”

Further deepening of reforms of Housing and Public Utilities is one of the priorities of implementing economic programme of the state for 2007. Significant role in successful implementation of the state policy in this sphere is devoted to associations of individual proprietors of housing, which are created for providing joint management and maintenance, preserving and repair of housing, as well as exploitation of common property of private proprietors of flats in a multi-flat house.

President of the Republic of Uzbekistan I. Karimov in his speech “Our main aim is democratization and renewal of society, reformation and modernization of the country” at a joint meeting of Legislative Chamber and Senate of Oliy Majlis (Parliament) on February 28, 2005, speaking about the most important priorities of economic reforms, particularly stressed on necessity of paying the most serious attention on reforms of housing and public utilities. He pointed out unsatisfactory work on management of multi-flat housing and existed shortcomings in organizing activity of established associations of individual proprietors of housing, lack of market mechanisms in sphere of housing exploitation and maintenance.

In order to fulfill aforesaid tasks and providing assistance in solving problems in regions, the Legislative and Judicial Committee of the Senate of Oliy Majlis jointly with Kengash (Assembly) of People’s Deputies of Tashkent city in march 2007 conducted monitoring of activity of associations of individual proprietors of housing.

After discussions of the monitoring results on joint meeting of the Legislative and Judicial Committee of the Senate and Kengash of People’s Deputies of Tashkent city a Resolution was adopted. The main aim of the resolution is to implement measures directed at eliminating shortcomings while executing requirements of the Law of the Republic of Uzbekistan “On Associations of Individual Proprietors of Housing” in Tashkent.

On April 18 2007, Seminar “Place and Role of Associations of Individual Proprietors of Housing in Reforms of Housing and Public Utilities” was held. The seminar was organized by the Legislative and Judicial Committee of the Senate of Oliy Majlis and Tashkent Khokimiyat (Local Administration). The aim of the seminar was to provide assistance to chairmen of district associations of individual proprietors of housing in forming skills for judicial solving the problems related to exploitation and maintenance of housing.

It was stipulated on the seminar that while implementing norms of the Housing Codex of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan “On Associations of Individual Proprietors of Housing” and other legislative acts, reorganization of associations of individual proprietors of housing has been accomplished in Tashkent and total number of the associations comprised 2,086. Contractual relations are being enhanced between the associations and enterprises, which provide communal, repair and construction services. In order to develop competitive environment in sphere of serving housing, alternative service companies were established, the work is being implemented to optimize a number of houses, which are served by one association.

Also attention of the seminar participants was driven to existed shortcomings in activity of the associations of individual proprietors of housing, which are connected with implementation of legislative requirements. It was noted that majority of associations do not implement their legal rights in spheres of using soft credits and loans issued for improving their financial situation and development of competition while providing services in housing and public utilities, entrepreneurship in stipulated limits. Some associations of individual proprietors of housing did not create conditions for providing additional services to inhabitants, there are cases when measures against received complaints were implemented not in time, land plots were formalized not in compliance of requirements.

During discussions the seminar participants broadly exchanged with their views and stressed on necessity of strengthening cooperation between the associations of individual proprietors of housing and local state bodies, organizations and enterprises, providing them with required support and assistance.

During seminar a number of proposals and recommendations was made, which are directed at solving problems in regions by providing legislative requirements in full and undertaking necessary measures to eliminate existed shortcomings in the associations’ activities, raising their role in deepening reforms of housing and public utilities.

Senators, representatives of the Cabinet of Ministers, Supreme Court, General Prosecutor’s Office, Ministry of Justice, UzCommunHizmat Agency, Institute of Monitoring of Active Legislation under the President of the Republic of Uzbekistan, Institute of Civil Society, Ombudsman, Tashkent city Khokimiyat, district Khokimiyats and associations of individual proprietors of housing of Tashkent city, Charity Fund “Mahalla” and other organizations, authorities, as well as Mass Media participated in the seminar.
