Opposition faction of SDP Adolat discussed draft bill

The Legislative Chamber of Oliy Majlis of Uzbekistan held a meeting of the opposition faction of the Social Democratic Party “Adolat”, which discussed the draft law “On protection of labor” in the new edition, adopted by the lower house in the first reading in January of a current year.

Members of the faction supported the introduction of new regulations which clearly define the powers of state bodies in the field of occupational safety and health, the concept of professional services to market participants on labor protection, which will contribute to the effective implementation of the requirements of international law in the area, in particular, a number of ratified by our country conventions of the International Labour Organization.

Deputies noted that the adoption of the Law “On protection of labor” in the new edition will allow to put in place rules that correspond to the new conditions, improve labor protection system, the responsibility for compliance with the law, improve efforts in protecting the life and health of employees, which in turn will contribute to the increasing of productivity.

The meeting expressed the position of fraction on the earlier suggestions voiced by the Bloc of Democratic Forces to exclude provisions providing for liability of officials for failure to fulfill the requirements of the specially authorized body in the field of labor due to the fact that the legislation of the act does not provide for administrative liability. Members of the faction noted that the existence of this provision in the bill will increase the responsibility of officials for compliance with legislation on occupational safety and health, which will create favorable conditions for workers, reduce the number of accidents at work and occupational diseases. Therefore, along with the preservation of the provision in the bill should consider amending the Code of the Republic of Uzbekistan on administrative responsibility, establishing liability for failure to perform the requirements of the authorized body.

The participants of the meeting emphasized that the new rules, provided in the bill, are essential for the creation of favorable conditions of work and to ensure its security in accordance with international principles and standards, strengthening employers’ responsibility for compliance with the requirements of labor protection legislation, reduce the number of accidents at work and occupational diseases.

Supporting the bill as a whole, the meeting members noted that some of its standards should be revised by taking into account the similar provisions of the Labour Code of the Republic of Uzbekistan. In addition, it pointed out the need for a clear definition of specially authorized bodies, whose functions include providing state control and supervision over observance of legislation on labor protection.

Following the meeting, faction of SDP “Adolat” developed its position on providing recommendations to the responsible committee for the bill further development.
