On March 31, 2016 in Tashkent the fifth plenary session of the Senate of Oliy Majlis of Uzbekistan was opened. It was attended by invited members of the Cabinet of Ministers, heads of ministries and departments, representatives of other organizations, the media.
Chairman of the Senate of Oliy Majlis N.Yuldoshev led the meeting.
Senators started with the consideration of the Law “On parliamentary control”. It was noted that in recent years, according to the Concept of further deepening democratic reforms and formation of civil society in the country which was developed by the Head of state and approved by the parliament, measures have been implemented to enhance the role of Parliament in the government system, a large-scale endeavors have been conducted aimed at consistent implementation of the constitutional principle of separation of powers, extension of the power and control functions of the Oliy Majlis, representative bodies in places.
In 2014 it was made amendments and additions to the Constitution of the Republic of Uzbekistan, aimed at constitutional recognition of the parliamentary control institute, the further expansion and strengthening of the control functions of the legislative powers, increasing the responsibility of bodies of state authorities and administration for the execution of the law.
At the solemn meeting dedicated to the 23rd anniversary of the Constitution, the President of our country stressed the need for adoption of the Law “About parliamentary control”.
The main purpose of the considering law was the creation of an integrated system of legislative base of the parliamentary control over the execution of requirements of the Constitution and laws, increasing efficiency and accountability of public authorities for the realization of their entrusted tasks and functions, as well as the most important state programs.
The law defines the subjects and objects of parliamentary control, its forms have been fixed, the measures taken as a result of parliamentary control have been regulated.
As noted at the meeting, organizational and legal measures in the consolidation of the law are of particular significance that may be adopted on the results of parliamentary control, as well as the duties of subjects of parliamentary control and state authorities in the course of its realization.
According to the senators, the adoption of this law will be an important factor in the further implementation of the constitutional principle of separation of powers, creating between them an effective system of checks and balances, strengthening the role of the Oliy Majlis in the system of public authorities, ensuring the rule of law, legitimacy, the execution of the Constitution and laws of the Republic of Uzbekistan, increasing an accountability of bodies of state power and management for the execution of their tasks. The law has been approved by the senators. Then the senators considered the Law of the Republic of Uzbekistan “On the accounting” (new edition) submitted to the lower chamber of the Oliy Majlis by the Cabinet of Ministers. It was noted that the law is aimed at improving the legal regulation of accounting system in accordance with international principles and standards, increasing transparency of accounting, as well as the responsibility of managers of business entities, their accounting services through the clear delineation of their rights and obligations.
During the plenary meeting the representatives of the parliament’s upper chamber considered the Law of the Republic of Uzbekistan “On introducing amendments and additions to some legislative acts of the Republic of Uzbekistan”, whose main purpose is to further improve current legislation in the socio-political, socio-economic, legal and judicial spheres.
This law introduced amendments in the Criminal Code, the Criminal Procedure Code, the Civil Code, the Code of the Republic of Uzbekistan on administrative responsibility, the laws “On the non-state non-profit organizations”, “On operative-search activity”, “On ensuring state pensions for citizens”, “On joint-stock companies and protection of shareholders’ rights “, “On consumer protection”, “On technical regulation”, “On Subsoil”, a number of other legislative acts.
Thus, this law made amendments to legislation aimed at further improvement of the investment climate and business environment, the development of entrepreneurial activity.
Senators considered the Senate Commission of the Oliy Majlis of the Republic of Uzbekistan to monitor the activities of the prosecution. It is noted that during the years of independence significant scale work has been carried out on reforming the judicial system, aimed at ensuring the rule of law, the legitimacy in the country, protection of the rights and freedoms of citizens.
In accordance with the constitutional mandate, the senators, in the course of the fifth plenary session heard a report on the activities of the Chamber of Accounts of the Republic of Uzbekistan for 2015.
In conditions of strengthening parliamentary control over the activities of executive bodies, in particular, on the execution of the State budget of the country, the professional activities of the Chamber of Accounts is one of the most effective mechanisms to monitor and ensure targeted and efficient expenditure of budgetary funds. A comprehensive analysis of the Chamber of Accounts, development of recommendations and proposals for further improvement of its work are one of the most important functions of the Senate.
The activities of the Chamber of Accounts was carried out on the basis of the tasks defined by the head of state at a meeting of the Cabinet of Ministers dedicated to the socio-economic development in 2014 and priorities of economic program for 2015, held on January 16, 2015.
In accordance with the Budget Code of the Republic of Uzbekistan, an external audit and evaluation of the report on the execution of the State Budget of the Republic of Uzbekistan in 2014 were conducted, examination of the main directions of fiscal policy and the draft State Budget of Uzbekistan for 2016 was carried out. As a result of audit and expertise, the appropriate conclusion of the Chamber of Accounts was introduced to the Cabinet of Ministers.
In the reporting year, the Chamber conducted monitoring activities at 90 entities of the country in 30 directions.
Following the monitoring results, 28 information letters of the Chamber of Accounts, including a list of measures to eliminate the detected violations of the law, as well as proposals to improve the regulatory and legal acts were addressed to ministries and agencies. As a result of these measures during the reporting period, 75.9 billion soums (currency rates of CB RU from 08.04.2016, 1$= 2882.68 soums) were imposed for the state revenue.
During the discussion of the report, the senators made recommendations aimed at strengthening and improving the effectiveness of control measures of the Chamber of Accounts, the adoption of the necessary measures to reduce financial crime and prevent them in the future. The proposals to enhance the interaction between the Chamber of Accounts and the Oliy Majlis in the implementation of parliamentary control over the execution of State Budget were developed.
The representatives of the upper house of Parliament heard a report on the activities of the Authorized person of the Oliy Majlis of the Republic of Uzbekistan for human rights (Ombudsman) in 2015. The activities of the Ombudsman last year were aimed at implementing measures to enhance parliamentary control over the observance of rights and freedoms by bodies of state power and governance, their officials, facilitating the improvement of legislation in this area.
A number of events has been held to improve the legal culture of the population and strengthening the interaction between civil society institutions with state authorities and management, law enforcement and judicial structures, improving the mechanism of public control over their activities in protecting the rights and freedoms of people.
Particular attention was given to the Ombudsman’s consideration of citizens’ complaints on violations of their rights and freedoms, the adoption of legal measures for their recovery.
Ombudsman noted a tendency of growth of legal culture and legal literacy among the population.
In 2015, the Ombudsman actively participated in the development of a number of laws aimed at further deepening of democratic reforms in socio-economic,socio-political and judicial-legal spheres. Much work has been done to implement the resolution of the Senate “On Amnesty in connection with the twenty-third anniversary of the adoption of the Constitution of the Republic of Uzbekistan”.
During the discussion, senators made several proposals and recommendations on further improvement of the activity of Ombudsman.

Facets of Cooperation
The German company Dobersek Engineering intends to commission a new furnace at the smelter of Almalyk Mining and Smelting Plant (AMSP) this September.
The project is financed by $34.6 million of the plant’s own funds, a $29 million loan from the Reconstruction and Development Fund, and a $34.1 million loan from the Ipoteka Bank.
The construction of buildings has been completed, equipment delivered. The installation and commissioning works will start in the near future. After a test run, the experts will deliver the furnace to the plant.
Meanwhile, representatives of the German company are currently negotiating with O’zkimyosanoat on the opportunity of construction of new complex fertilizer production in Navoi region. Engineering Dobersek Gmbh submitted a proposal for the construction of the complex, the Uzbek side made some remarks, so specialists are currently working on the revised draft.
So far, experts study the logistics and decide on the exact location of the project. There are two main proposals: the first one suggests the construction of the entire complex in one location, and the second one proposes building an ore processing site at the Kyzylkum Phosphorite Plant, and establishing the rest of chemical facilities closer to the city.
It stands to reason that the project is partnered by the German company. It has been operating in the Uzbek market for over 20 years and has implemented more than a dozen tech turnkey projects, including the modernization and expansion of capacities of the Kyzylkum Phosphorite Plant, which will be a base area for the new production.
German experts have been involved in the project for nearly four years. They transported about 12 tons of ore from the Kyzylkum desert deposits for semi-industrial tests at production facilities in Germany and Tunisia. The results turned out good, showing the economic feasibility of the project.
